ZEALAND LIMITED (“Comvita”), a company incorporated in New Zealand with
registered number 1413464, and whose principal place of business is at 23
Wilson Road South, Paengaroa, New Zealand.
Petty Wood & Co Limited (a company incorporated in
England and Wales with registered number 00082419 and whose principal place of
business is at Livingstone Road, Walworth Business Park, Andover, Hampshire
SP10 5NS) (“Petty Wood”) is responsible for operating the website, (including
marketing communications, customer engagement and analytics) and fulfilling
orders from the website (including payments, delivery, and customer service
relating to purchases).In these Terms, “we”, “us” or “our” means Petty Wood and
Comvita. “You” and “your” means any person accessing or using the Website.
1. ACCEPTANCE OF THESE TERMS
1.1 These Terms govern your access to and use of the
Website.
1.2 By using the Website, you confirm that you accept these
Terms and agree to comply with them. If you do not agree, you must not use the
Website.
1.3 We may update these Terms from time to time. Updated
Terms will be posted on the Website and will take effect from the date of
publication. Your continued use of the Website constitutes acceptance of the
updated Terms.

2.4 All trademarks and logos shown on the Website are either
owned by Comvita or a third party. No rights are granted to use any trademarks
or logos which appear on the Website other than as expressly set out in this clause
2. For the avoidance of doubt, you may not use any meta tags or any other
hidden text utilising Comvita’s trademarks without our prior written permission

acknowledge and agree that in no event will Comvita and/or Petty Wood, their
officers, directors, employees or agents be liable to you in contract, tort
(including negligence and breach of statutory duty) or otherwise for any
direct, indirect, incidental, special, consequential or exemplary damages,
including but not limited to, damages for loss of profits, goodwill, use, data
or other intangible losses (even if we have been advised of the possibility of
such damages) resulting from:
- a. the use or the inability to use the Website;
- b. the cost of obtaining substitute goods and/or
services resulting from any data, information or - c. service obtained or messages received or
transactions entered into through or from the Website; - d. unauthorised access to or alteration of your
transmission or data; - e. statements or conduct of any third party that

9.5 In the event that we are held
liable by a court of competent jurisdiction, for any loss you suffer as a
result of your use of, or inability to use, the Website, our maximum liability
to you will be limited to £100.

negligence or for any liability which cannot be excluded or limited by law.

10. GOVERNING LAW
10.1 These Terms are governed by the laws of England and
Wales.
10.2 If you are a consumer resident in Scotland or Northern
Ireland, you may also bring proceedings in your local courts.
10.3 If you are a business user, the courts of England and
Wales shall have exclusive jurisdiction.

12. GENERAL
12.1 If for any reason any part of these Terms is deemed to
be unenforceable, then this part of the Terms will be severed and this will not
affect the validity or enforceability of the remaining terms.
12.2 Any waiver of a breach of any provision of these Terms
shall not be deemed to be a waiver of any subsequent breach of any provision.12.3
We may transfer our rights and obligations under these Terms to another
organisation, but this will not affect your statutory rights. We will inform
you in writing if this happens.
12.4 These Terms constitute the entire agreement between you
and us regarding use of the Website (business users only) and supersede any
prior agreements between you and Comvita in relation to the Website.
