TERMS OF SALE

These Terms of Sale apply to purchases of goods (“Goods”) from www.comvita.co.uk (the “Website”).

The Website is operated by Petty Wood & Co Ltd, registered in England and Wales (company number 00082419) with registered office at Seebeck House 1 Seebeck Place, Knowlhill, Milton Keynes, Buckinghamshire, United Kingdom, MK5 8FR (“Petty Wood & Co Ltd”, “we”, “us”, “our”). VAT number: GB 765 346 017.

By placing an order, you agree to these Terms of Sale.


1. ELIGIBILITY

1.1 You must be at least 18 years old to place an order.

1.2 If you are purchasing on behalf of a business, you confirm that you have authority to bind that business.


2. OUR CONTRACT WITH YOU

2.1 Product descriptions on the Website constitute an invitation to treat, not a binding offer.

2.2 When you place an order, you are making an offer to purchase Goods.

2.3 After placing your order, you will receive an order acknowledgement email. This does not mean your order has been accepted.

2.4 A legally binding contract is formed only when we send you a dispatch confirmation email.

2.5 We reserve the right to reject orders, including where:

  • Goods are unavailable;
  • Payment is not authorised;
  • There is a pricing or product description error;
  • We suspect fraud or unlawful activity.

3. PRODUCTS

3.1 Images of Goods are for illustrative purposes only. Packaging may vary.

3.2 We make reasonable efforts to ensure product descriptions and prices are accurate.

3.3 Information provided about supplements or health-related products is for general information only and is not medical advice. Always consult a qualified healthcare professional before use where appropriate.


4. PRICE AND PAYMENT

4.1 Prices are shown in GBP (£) and include VAT where applicable.

4.2 Delivery charges are displayed at checkout before you confirm your order.

4.3 We accept payment methods displayed at checkout.

4.4 Payment must be received in full before Goods are dispatched.

4.5 If we discover a pricing error:

  • If the correct price is lower, we will charge the lower amount.
  • If the correct price is higher, we will contact you for instructions before dispatch.

5. DELIVERY

5.1 We deliver to addresses only within the United Kingdom.

5.2 Estimated delivery times are provided for guidance only and are not guaranteed.

5.3 Risk in the Goods passes to you upon delivery.

5.4 Ownership of the Goods passes to you once full payment has been received.

5.5 If delivery is delayed due to events outside our reasonable control, you will be provided with a tracking number and we will contact you as soon as possible.


6. YOUR RIGHT TO CANCEL (CONSUMERS)

This clause applies to consumers only.

6.1 Under the Consumer Contracts Regulations, you have the right to cancel your order within 14 days without giving any reason.

6.2 The cancellation period expires 14 days after:

  • The day you receive the Goods; or
  • The last item of a multiple delivery order.

6.3 To exercise your right to cancel, you must inform us by email at comvita@pettywood.co.uk before the cancellation period expires.

6.4 You must return the Goods within 14 days of notifying us of cancellation. Goods are returned at your risk and we recommend using a tracked service.

6.5 You are responsible for return postage costs unless Goods are faulty or misdescribed. If faulty please contact us at comvita@pettywood.co.uk to arrange a refund or pre-paid postage label.

6.6 We will refund:

  • The price of the Goods

6.7 Refunds will be processed within 14 days of:

  • Receiving the returned Goods; or
  • Receiving evidence that you have returned them.

6.8 We may make a deduction from your refund if the value of the Goods has been reduced due to handling beyond what is necessary to establish their nature, characteristics and functioning.


7. EXCEPTIONS TO THE RIGHT TO CANCEL

You do not have the right to cancel if:

  • Goods are sealed for health protection or hygiene reasons and become unsealed after delivery;
  • Goods are personalised or made to your specification;

8. FAULTY OR MISDESCRIBED GOODS

8.1 We are legally obliged to supply Goods that conform with the contract.

8.2 If Goods are faulty or not as described, you are entitled to remedies under the Consumer Rights Act 2015, including repair, replacement or refund.

8.3 If a fault appears within 30 days of delivery, you may reject the Goods for a full refund.

8.4 After 30 days, we may offer repair or replacement before issuing a refund.

Nothing in these Terms affects your statutory rights.


9. LIMITATION OF LIABILITY

9.1 We are responsible for foreseeable loss or damage caused by our breach of contract or negligence.

9.2 We are not liable for:

  • Loss of profit;
  • Loss of business;
  • Business interruption;
  • Loss of business opportunity.

9.3 Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence;
  • Fraud or fraudulent misrepresentation;
  • Defective products under the Consumer Protection Act 1987;
  • Any matter that cannot be excluded by law.

10. PROMOTIONS AND DISCOUNT CODES

10.1 Promotional codes are subject to separate terms stated at the time of issue.

10.2 We reserve the right to withdraw or amend promotions at any time.


11. PRIVACY

We process personal data in accordance with our Privacy Notice.


12. GOVERNING LAW

12.1 These Terms are governed by the laws of England and Wales.

12.2 Consumers resident in Scotland or Northern Ireland may bring proceedings in their local courts.

12.3 If you are purchasing in the course of business, the courts of England and Wales shall have exclusive jurisdiction.
